How It Works

We list and actively market your jewelry on your behalf, leveraging our established clientele and digital presence to connect your piece with its next owner. Our consignment term begins with an initial 90-day period, after which it automatically renews on a month-to-month basis for a maximum total period of two years. Should the item remain unsold at the conclusion of the two-year period, it will be made available for client retrieval.

Our commission is 25% of the listed price — retained at the time of sale.

Payment

Upon the successful sale of a consigned item, the client will receive a check for the agreed-upon price within 90 days of the date of sale.

What to Expect

Acceptance of Consignments

Consignment agreements at Market Street Diamonds are accepted exclusively by our CEO, Mr. Dino Lozano. All consignment inquiries must be directed to and approved by Mr. Lozano before any item is received or listed.

Eligibility

Consignment through Market Street Diamonds is available to clients who originally purchased their piece from us. In select cases, we may extend this service to jewelry not originally purchased with us, at our discretion.

Please note that consignment is a marketing service, not a guarantee of sale or an obligation to purchase. We work diligently on your behalf, but all outcomes depend on market interest and buyer activity.

Consignment Terms & Conditions

By submitting jewelry for consignment with Market Street Diamonds (MSD), the client automatically agrees to the following terms and conditions. It is the client's sole responsibility to read and understand this information prior to proceeding. If these terms do not meet the client's needs, the consignment may be cancelled at any time.

1. Agreement & Acceptance

Engagement in MSD's consignment service constitutes full acceptance of these terms and conditions. No separate signature or acknowledgment is required beyond the client's decision to proceed. MSD reserves the right to amend these terms at any time; continued consignment following any update constitutes acceptance of the revised terms.

2. Authorization & Approval

Consignment agreements at Market Street Diamonds are accepted exclusively by the Chief Executive Officer. No consignment is considered valid or binding until formally approved by the CEO. Agreements made with any other MSD representative, verbally or otherwise, are not recognized and carry no obligation on the part of MSD.

3. Consignment Period

The initial consignment term is 90 days from the date of acceptance. Following the initial term, the consignment will automatically renew on a month-to-month basis for a maximum total period of two (2) years. Upon reaching the two-year maximum, the consignment will expire and the client will be notified to arrange retrieval of their item. MSD bears no responsibility for unsold items beyond the two-year period.

4. Commission & Pricing

MSD retains a commission of 25% of the listed price upon the sale of a consigned item. The listed price will be agreed upon by both parties prior to listing. MSD reserves the right to recommend pricing adjustments during the consignment period based on market conditions; however, no price change will be made without the client's consent.

5. Payment to Client

Upon the successful sale of a consigned item, the client will receive a check for the agreed-upon net amount — the listed price less MSD's 25% commission — within 90 days of the date of sale. Checks will be issued to the name on file at the time of consignment. MSD is not responsible for delays caused by incorrect or outdated client information.

6. Item Condition & Documentation

The client represents and warrants that any item submitted for consignment is accurately described and free of any undisclosed defects. MSD reserves the right to have items independently evaluated prior to listing. The client is encouraged to retain any original documentation, certificates, or appraisals associated with the item, copies of which may be requested by MSD to support the listing.

. Insurance & Liability

While items are in MSD's possession, reasonable care will be taken to ensure their safekeeping. However, MSD's liability is limited to the agreed listed price of the item. Clients are encouraged to maintain their own insurance coverage for consigned pieces. MSD is not liable for loss or damage resulting from circumstances beyond its reasonable control, including but not limited to theft, natural disaster, or acts of God.

8. Cancellation

Either party may cancel the consignment at any time.

The client may withdraw their item if these terms do not suit their needs, provided the item has not already been sold or is not subject to a pending transaction. MSD reserves the right to cancel any consignment at its sole discretion, for any reason, at any time, with reasonable notice provided to the client where possible.

9. Suspected Stolen Property

If MSD has reasonable cause to suspect that a consigned item is stolen or otherwise unlawfully obtained, we reserve the right to notify the appropriate authorities and cooperate fully with any resulting investigation. The consignment will be immediately suspended pending resolution, and MSD bears no liability for delays or losses arising from such circumstances.

10. Pricing & Commission Disputes

If a disagreement arises regarding the listed price of an item or the commission charged by MSD, the consignment agreement will be considered terminated. MSD's commission structure is non-negotiable once agreed upon at the time of acceptance.

11. Client Conduct

MSD is committed to maintaining a respectful environment for our team and clients alike. Any consignment will be immediately terminated if the owner engages in disrespectful behavior toward MSD staff, including but not limited to the use of derogatory language or any conduct deemed inappropriate or hostile. MSD's determination of unacceptable conduct is final.

12. Unclaimed Jewelry

Upon termination or expiration of a consignment — for any reason — the client is responsible for retrieving their jewelry within a reasonable timeframe as communicated by MSD. If the owner refuses or fails to collect their item, MSD reserves the right to engage a licensed third-party entity to take lawful possession of the jewelry. Any costs associated with this process, including storage, legal, or administrative fees, will be the responsibility of the client.

13. Ownership Representation

By submitting an item for consignment, the client confirms that they are the sole legal owner of the item and have full authority to authorize its sale. MSD accepts no liability for disputes arising from contested ownership, and the client agrees to indemnify MSD against any claims, losses, or legal costs resulting from misrepresentation of ownership.

14. Marketing & Photography

MSD reserves the right to photograph, describe, and market consigned items across any channels it deems appropriate, including its website, social media platforms, and in-store displays. The client grants MSD a non-exclusive license to use images and descriptions of the item for marketing purposes during the consignment period. These materials may be removed at MSD's discretion upon termination of the consignment.

15. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which MSD operates. Any disputes arising from this agreement that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the applicable courts.

These terms are subject to change at MSD's discretion. Clients will be notified of material updates.
